To safeguard the rights and welfare of all children in Kenya through implementation of relevant policies, coordination, supervision and delivery of services.

Background
Children found to be in difficult circumstances often need to be rescued and put in places of safety for care and protection over a period of time. A charitable children institutions (CCIs) is one such institution.

Categories of children placed in CCI’s vary from one CCI to another  & range from:

  • Abandoned;
  • Neglected;
  • Sexually, physically, emotionally and psychologically abused;
  • Orphaned;
  • Street children; and
  • Children with disabilities


Services offered to children in CCI’S  are tailored  to meet the needs of the particular category of children admitted there in and include provision of basic needs such as food, shelter, clothing, education, medical care, guidance and  spiritual well.


What is a Charitable Children’s Institution? (CCI)

A Charitable Children Institution (CCI) means a home or institution which has been established by a person, corporate or unincorporate, a religious organization or a non-governmental organization and has been granted approval by the National Council for Children Services (NCCS) to manage a programme for the care, protection, rehabilitation or control of children.

What a CCI is Not

  • a rehabilitation school established by the Minister under Section 47;
  • a school within the  meaning of the Education Act;
  • a borstal institution;
  • any health institution; or
  • a children’s day care, nursery or other similar establishment.


Administering Authority:

The person or organization registered to run an institution e.g. if a church is registered to run an institution, then the church is the Administering Authority.

Placing Authority

Refers to the person or organization that takes or “places” a child in an institution. This can be a Children’s Court, a Children’s Officer or an Authorized Officer as defined in the Children Act Part 1 and CCI regulations 2005 (Preliminaries).

Section 72 of the Children Act 2001 obligates the Minister in charge  of Children Affairs in consultation with the NCCS to make regulations for better running of CCIs.
No organization shall operate as an institution unless it has been registered under these Regulations.

Charitable Children's Institutions Regulations

The Charitable Children’s Institutions Regulation(2005)were developed to provide standards upon which CCI’s shall operate. CCIs are required to observe children’s rights as stipulated in the United Nations Convention on the Rights of the Child (UNCRC) 1989, and the African Charter of the Rights and Welfare of the Child (ACRWC). This is to ensure maximum survival and development of children, non-discrimination, respecting of children’s right to air opinions and the best interests of the child as a guiding principle. Registration requirements:

  • CCIs shall apply through the Area
  • Advisory Council (AAC) operating in that area.
  • Where a person or body of persons wish to operate more than one institution, they shall present separate applications for each institution.
  • In the case of an unincorporated body of persons: a list of trustees of that body;
  • In the case of a body corporate or any other body which is by law required to be registered: a certificate of registration;
  • copy of the proposed mission or policy statement of the institution;
  • Any registered CCI that want to change  mission/vision can notify the AAC through the District Children’s Officer (DCO).


What Area Advisory Council shall do

  • AAC shall acknowledge receipt of application within 30 days after the date of receipt;
  • Shall indicate the date (which shall not be later than thirty days from the date of receipt) when to inspect the premises;
  • If the institution does not meet the required criteria, they shall be informed as such with appropriate information on which areas require improvement before approval;
  • If it meets the set criteria, the Director shall with the approval of the NCCS, recommend to the Minister to issue a certificate of Registration.

  • Application form (First schedule of the CCI Regulations)
  • AAC minutes (that approved registration)
  • AAC Inspection report (with recommendation for registration)
  • Public health inspection report (with recommendation for registration)
  • Mission and Policy statement (to comply to Schedule 9 of the CCI Regulations)
  • Audited financial accounts/books of accounts
  • Certificate of corporate registration/ legally constituted list of trustees
  • Children’s complaint procedure
  • Behavior management policy for children
  • Certificates of good conduct for all staffs from the police
  • C.Vs for all staffs
  • Medical certificates for food handlers
